1. GENERAL TERMS
Work days: Monday to Friday 9:00 am to 5:00 p.m (Mexico city)
All drawings for personal use will include a subtle signature that you may not remove.
After paying (or making the first payment), you automatically agree to these Terms of Service. Commissioning means that you have read my ToS and I am able to hold you to that.
I reserve the right to refuse commissions and ideas that do not align with my ToS or morals no matter my reasoning
I don't do NFTs, NSFW, mecha, gore, political work, realism
I DO NOT work with NSFW references or AI Generated references
Prices are subject to change, each project is priced differently.
To be able to process your order I will send you a google form
I reserve the right to refuse any commission
2. PAYMENT
If your payment is in MXN you can pay through paypal or through money deposit.
Payments in USD are done through paypal only
Commissions can be paid either 100% upfront or split 50% upfront and the 50% to receive the final file.
Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.
Payment Methods: Payments for commissions can be made through the following methods:
PayPal: If you're paying in MXN (Mexican Peso) or USD (United States Dollar), you can use PayPal for secure transactions.
Money Deposit: For payments in MXN, you have the option to deposit the agreed amount directly into the artist's bank account.
Currency and Exchange Rates: All prices are listed in MXN unless otherwise specified. For payments in USD, the exchange rate will be determined at the time of payment and may be subject to fees charged by financial institutions or PayPal.
Payment Terms:
Full Payment: You have the option to pay the full amount upfront at the time of commissioning.
Split Payment: Alternatively, you may choose to split the payment, with 50% due upfront to secure your commission slot and the remaining 50% upon completion of the artwork.
Payment Procedure:
Confirmation: Do not send any payment until the artist has confirmed your commission slot and requested payment.
Payment Request: Once the details of your commission have been finalized, the artist will send you an invoice or payment request via the agreed-upon method (PayPal or bank deposit).
Payment Deadline: Payment must be made within [insert timeframe, e.g., 48 hours] of receiving the invoice or payment request to secure your commission slot. Failure to do so may result in the forfeiture of your slot and delay in the commission process.
International Payments: For clients making payments from outside Mexico, please ensure that any currency conversion fees or international transaction fees are covered by you to avoid any discrepancies in the final payment amount.
Payment Acknowledgment: Once payment has been received, you will receive confirmation from the artist, and work on your commission will commence according to the agreed-upon timeline.
3. PROCESS AND DELIVERY
The delivery time for illustrations varies from 2 weeks to 1 and a half months. It depends on certain factors such as revisions, complexity of the piece, and other assigned work. If it's a complete project like a book, mascot design, etc., it can vary. Some illustrated book projects can take up to 3 months depending on the number of illustrations and complexity.
If anything comes up that will slow the progress of the initially estimated delivery time I will let you know ASAP.
Once the piece is finished you will receive the full-resolution image via email. Note that there is no physical product.
If you need your commission for a certain date please tell me so I can check if I can fit the schedule.
4. REVISIONS (*doesn't apply for orders that don't have revisions)
You get 2 rounds of MAJOR changes during the sketching phase of the commissioned piece and 1 round of MINOR changes during the lineart phase. (*doesn't apply for orders that don't have revisions)
You get 1 edit on the final color
A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.
If you wish to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.
I don't accept changes in body structure, pose, perspective, etc., after the sketch has been approved and coloring has begun.
⚬ MAJOR CHANGES: Changing hair elements / eye/mouth positioning / colors / pose / perspective
⚬ MINOR CHANGES: Changing the expression/ Minor details of the clothes/Changing the color / highlights / shadows / FX.
A fee will be added in changes that are not included in the price - unless a misunderstanding from my side has been made.
If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.
No changes can be requested after the final illustration is delivered.
5. COPYRIGHT / USAGE POLICY
I, Elisa Glez (the artist), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:
Promote myself with it everywhere
Display it everywhere to my liking (website, social media, etc.)
Post it wherever I want.
The buyer is allowed to:
Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
Print the artwork
For OC you can claim the character as your own since it's your own character but, you can't claim ownership on the artwork itself. The credit of the art it's still on the artist.
Use the artwork to promote themselves. You are not forced to give me credit when you post it but it is very appreciated.
Use the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.
The following is considered copyright infringement:
Reproducing/using the copyrighted artwork commercially (means making money off it in any way) unless agreed otherwise beforehand.
Claiming the artwork as your own.
Removing my signature from the artwork.
Altering the artwork without my consent.
I reserve the full rights to the image and it's use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).
6. CUSTOMER SATISFACTION
I will do everything I can to make my customers happy.
If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together.
I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this.
Full/partial refunds are not applicable if ever the client is unsatisfied with the finished piece. I always ask the client if they would like to have anything revised during the sketching phase. Please settle all revisions by then.
7. REFUND / CANCELLATION POLICY
The buyer is not allowed a full refund once I start working on the piece.
If the client would like to cancel the commission if I have not started yet and if they paid the full amount already, 40% of the full price will be refunded. Refunds don't apply once the project has started.
If for any reason I am unable to start your commission you will receive a full refund
If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.
If the client hasn't sent over the full/partial payment after a week, they or I have the right to cancel the commission.
If the buyer breaks any of the points stated above they will lose all the aforementioned rights to the artwork commissioned by me, Marie (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying your commissioned piece.
Before paying the advance if you show or tell me the code: COMISSION2024V1 I will give you a 10% of discount. This only applies if you have read all the TOS and before paying you show me the code. *This code will be changing* . If you already made your payment and later on you show me the code, the discount won't apply.
7. COMMERCIAL FEE
If you wish to purchase the rights to a completed image, you will have to pay a monetization fee or a rights fee
A monetization fee allows you to use it on monetized streaming platforms such as twitch or youtube.
A rights fee gives you all rights to the image for resale. This means you can use it for stickers, shirts, streams, etc depending on which fee you have paid for.
